This website is subject to the provisions of the Consumer Protection (Distance Selling) Regulations and specifically Regulation 13 (C). whereby customers are entitled to a 7 day cancellation period. However this does not apply where goods are personalized and made to customer specifications (exception under Regulation 13(c)). Non Personalised good can be returned within 7 days of receipt for a full refund.
Any problems with faulty goods should be reported to CM Wedding Vitations on the telephone number given above or quoted in the Contact section of the website.
"the Buyer" shall mean the person, firm or company with whom any contract is made;
"CM" shall mean CM Wedding Invitations
"the Goods" shall mean any goods the subject of an order by the Buyer whether or not on CM's standard order form and agreed to be sold by CM to the Buyer.
1 Any order by the Buyer for Goods from CM is deemed to incorporate these terms and conditions to the exclusion of any other terms and conditions and no variation or modification of or substitution for these terms and conditions shall be binding on CM and any other proposed terms and conditions shall be void unless specifically accepted by a director of CM in writing.
2 If any provision of these terms and conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these terms and conditions and the remainder of the provision in general shall not be affected thereby.
3.1 Prices are determined by reference to CM's price list current at the date of acceptance of the order by CM subject always to the agreed discount off published recommended retail prices as notified in writing by CM to the Buyer from time to time and to extra charges where applicable for special non-standard services. CM reserves the right upon giving 7 days written notice to increase the price of the Goods, the buyer has the option to cancel the order and recieve a full refund.
3.2 All prices (save those relating to express delivery) are given by CM without postage paid. Postage costs are quoted prior to checkout on the site and are itemised at ‘shopping cart’.
3.3 The price (as set out on the published CM Price List from time to time) is inclusive of any applicable value added tax and the Buyer shall be additionally liable to pay to CM any others taxes which from time to time may be enforced.
4 If payment of any sum due hereunder is not made on the due date then without prejudice to any other right or remedy available to CM. CM shall be entitled to charge the Buyer interest (both before and after any judgement) on the amount due but unpaid at the rate of 4 per cent. per annum above Ulster Bank rate from time to time until payment is made.
5.1 Delivery of the Goods shall take place at the Buyer's premises or at such other location as the Buyer shall have previously notified CM in writing or over the phone.
5.2 If CM fails to deliver the Goods for any reason other than any cause beyond CM's reasonable control or the Buyer's fault, and CM is accordingly liable to the Buyer.
6.1 Title to the Goods shall remain with CM and shall not pass to the Buyer until payment in full for the same and all other Goods agreed to be sold by CM to the Buyer for which payment is then due has been received by CM.
6.2 Risk of damage to or loss of the Goods shall pass to the Buyer at the time if delivery or, if the Buyer wrongfully fails to take delivery of the Goods, the time when CM has tendered delivery of the Goods.
6.3 The Buyer shall not be entitled to deposit or in any way charge by way of security for any obligation (monetary or otherwise) any of the Goods, which remain the property of CM, but if the Buyer does so all moneys owing by the Buyer to CM shall (without prejudice to any other right or remedy of CM) forthwith become due and payable.
7. CM shall not be liable to the Buyer or be deemed to be in breach of the agreement by reason of any delay in performing, or any failure to perform, any of CM's obligations in relation to the Goods, if the delay or failure was due to any cause beyond CM's reasonable control. Without prejudice to the generality of the foregoing, the following shall be regarded as causes beyond CM's reasonable control:
Act of God, explosion, flood, tempest, fire or accident;
War or threat of war, sabotage, insurrection, civil disturbance or requisition;
Acts, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority;
Import or export regulations or embargoes;
Strikes, lock-outs or other industrial actions or trade disputes (whether involving employees of CM or of a third party);
Difficulties in obtaining raw materials, labour, fuel, parts or machinery;
Power failure or breakdown in machinery.
The Buyer makes any voluntary arrangement with its creditors or becomes subject to an administration order or (being an individual or firm) becomes bankrupt or (being a company) goes into liquidation (otherwise than for the purposes of amalgamation or reconstruction); or
An encumbrancer takes possession, or a receiver is appointed, of any of the property or assets of the Buyer; or
The Buyer ceases, or threatens to cease, to carry on business; or
FI reasonably apprehends that any of the events mentioned above is about to occur in relation to the Buyer and notifies the Buyer accordingly; then without prejudice to any other right or remedy available to it, CM shall be entitled to cancel the contract or suspend any further deliveries under the contract without any liability to the Buyer, and if the Goods have been delivered but not paid for the price shall become immediately due and payable notwithstanding any previous agreement or arrangement to the contrary.
9.1 Any dispute, claims or proceedings of whatever nature between the Buyer and CM in connection with or arising out of the validity, construction or performance of this agreement shall be subject to the non-exclusive jurisdiction of the High Court of Justice in Northern Ireland and ENgland to which the Buyer and CM Wedding Invitations irrevocably submit.
9.2 The validity, construction and performance of this agreement shall be governed by English and Northern Irish Law.
10. Full refunds on personalised goods will only be issued due to errors made by CM Wedding Invitations, all other resolutions will be via replacement goods or discount vouchers. Full refunds are available on non personalised goods as long as we are made aware of the return within 14 days of purchase and the goods are returned within 28 days of purchase. Goods must be returned in a resaleable condition.
11. Free Shipping is available when you spend £50 or more on our website and is subject to delivery addresses within England, Wales, Northern Ireland, Scotland and Southern Ireland only.
12. Promotional codes can not be redeemed alongside any other promotion and may be subject to one use per customer or one per transaction. If a code is used on top of another offer, we reserve the right to cancel the order. Promotional codes must be redeemed at the time of purchase and will not be accepted at a later date. To redeem a code, please click on the "Basket" icon on the top right of the screen and select "View Cart" from the drop down menu. Please now enter your promotional code on this screen before completing checkout.
13. Free samples are limited to two per customer, two of the same invitation however cannot be purchased. If more than 2 samples are ordered, an invoice will be sent to the customer requiring payment for the additional invitation.
The following terms apply specifically to hire items.
Payment for Letter Lights
A £50 or €75 non-refundable deposit must be paid to establish the booking and secure the date / hire items required. The remaining balance will be due on or before 14 days prior to the function date / hire period begins. We will endeavour to notify you prior to this time of any payment due, however we cannot be held liable for this reminder; it is incumbent upon yourselves to make all payments at the appropriate stages. Payment can be made via Credit/Debit card via our online invoicing system or over the phone. Security Deposit for Letter Lights - We require a fully refundable security deposit of £100.00 at the time of delivery to protect against loss or damage that might occur while the letters are on hire. We operate a fair policy regarding this.
Period of Hire
The hire period for all of our props is 24 hours unless agreed prior to the function in writing / email by ourselves. You may not hire our item(s) to others; the person booking the items for this hire period must be the intended user.
The hirer shall indemnify and keep indemnified CM Wedding Invitations from any loss, damage or injury however caused from any negligent act, omission or breach of this contract by the Hirer or its agents, which occurs during the event.
CM Wedding Invitations carry full public liability insurance. However we recommend that separate “event” insurance be considered to cover against such eventualities as inclement weather, theft, equipment failure and any other unforeseen incidents. Loss & Damages
I being the hirer accept full responsibility for the condition of all hired items during the hire period or until returned to CM Wedding Invitations and will be liable for any damage incurred, or loss of said items. Repairs of damaged items will not be undertaken without the written authority of CM Wedding Invitations. All missing items or those damaged beyond repair will be paid for at current retail value. In using our services I also acknowledge that I have been provided with the authority to act on behalf of the party referred to as the “hirer”.
In the event of a force majeure (including but not limited to fire, casualty, accident, riot, war or other enemy action, act of God, strike, lock-out or labour conditions), which prevent the event, then the hirer shall pay all amounts for which CM Wedding Invitations is contractually bound to pay, including all deposits, cancellation fees and other liabilities. Please contact us as soon as possible to notify us of any changes to the event and we will do everything in our power to facilitate a change of date for you.
